In a big setback to West Bengal chief minister Mamata Banarjee and her government, the Kolkata High Court has issued a crucial directive, ordering a court-monitored Central Bureau of Investigation (CBI) probe into alleged incidents of sexual assault and land grabbing in Sandeshkhali. The Court said that “an impartial enquiry” was necessary “in the interest of justice and fair play”.
The division bench of Chief Justice T S Sivagnanam and Justice Hiranmay Bhattacharyya also directed the CBI to create a “dedicated portal” where complaints will be lodged to ensure confidentiality and provide security to victims and witnesses.
The division bench order came while hearing a bunch of petitions filed by women in Sandeshkhali who levied sexual assault allegations against local Trinamool Congress leaders.
Recognising the need for all possible assistance, the court emphasises the importance of the state facilitating the investigative process. The CBI is tasked with investigating all complaints, ranging from land grabbing to sexual assault and alteration of agricultural land, ensuring a thorough probe into every aspect of the case.
Under the watchful eye of the judiciary, the investigation will be closely monitored to uphold transparency and accountability throughout the process.
To enhance surveillance in sensitive areas, the bench directed the district administration in North 24 Parganas including the district magistrate and the district police superintendent to identify the sensitive pockets at Sandeshkhali and install CCTVs. The district administration was also directed by the court to properly illuminate the streets at Sandeshkhali.
The safety of witnesses is paramount, and measures will be taken to safeguard them from any potential harm or intimidation.The CBI is empowered to summon and investigate any individual without bias or prejudice, ensuring a fair and impartial inquiry into the matter.
“With regard to the protection to the victims and witnesses, CBI shall issue necessary directions to the State Police as to how and in what manner protection can be granted without insisting upon the strict procedure as stipulated under the Witness Protection Scheme,” it said.
The court has scheduled the next hearing for May 2nd, during which the CBI is expected to submit its report, marking a crucial step forward in the quest for justice.
