On Thursday, a Division Bench of the Telangana High Court dismissed the nominations of Dasoji Sravan and Kurra Satyanarayana for MLC posts under the Governor’s quota. The Bench, led by Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti, overturned the order issued by the Governor in September 2023. Furthermore, the High Court invalidated the notification released in January of this year by the current Congress government, proposing Kodandaram and American Ali Khan for the MLC positions.
It emphasized that the Governor must adhere to the advice of the Council of Ministers when exercising powers under Article 171(5) of the Constitution. The Bench stated in its ruling that the Governor has the discretion to reconsider the eligibility of the petitioners based on the Council of Ministers’ recommendation. Additionally, the court highlighted the Governor’s authority to refer the matter back to the Council of Ministers for reconsideration or to request clarification on the recommendations made.
